2.Purpose

These general conditions of sale (“CGV”) establish the rights and obligations applicable between:

André Dureux hereinafter referred to as the “Seller”

and the buyer (you) hereinafter referred to as the “Customer”.

The contractual language is French and only the General Conditions of Sale (CGV) in French are used as contractual reference between the Seller and the Customer.

3. Nature of the works sold

The original paintings offered for sale on the website “www.andredureux.com” were produced by the professional painter André Dureux. For some original paintings there is the possibility of purchasing a reproduction printed in a limited series, numbered and signed by the artist. These series are in any case limited to 30 copies (All formats, supports and original included).

Each work is the subject of a presentation on the website (photos and description). Each work is as much as possible consistent with their presentation, except possible error. The parties agree, however, that the photos and texts of the paintings offered for sale have no contractual value but simply provide information on the work presented.

Each painting is signed and countersigned on the back, with the artist’s reference, title, technique, date of creation, dimensions and stamp.

The original works are sold with a hanging system (free) installed on the back and delivered with invoice and certificate of authenticity.

4. General provisions

The general provisions apply to all sales made on the Seller’s website and form an integral part of the contract between the Customer and the Seller.

The Seller reserves the right to modify the general conditions of sale (CGV) at any time, without notice, by uploading a new version on its website. The applicable CGV are those in force on the date of payment for the order.

Any act of purchase implies clear and unreserved acceptance of the CGV by checking the validation box thereof. The Customer thus declares to have read all the CGV and any special sales clauses related to a product and to accept them without restriction or reservation. The Customer declares to be able to legally contract under French law. The information recorded by the Seller constitutes proof of the transactions carried out by the Customer.

5. Online ordering process

In order to be able to place an order, the Customer must create an account on the website with all the information allowing the purchase to be delivered to the postal address indicated and to be contacted, if necessary, by email and / or by phone. The customer agrees to provide accurate, reliable and valid information in order to make the delivery under good conditions.

The ordering process involves different stages, the main ones being:

– choice of table

– put in the basket

– validation of the basket

– verification and / or modification of delivery information

– acceptance of the CGV and the privacy policy

– confirmation of the order

– payment of the order

An invoice is generated and will be part of the delivery of the purchase to be shipped.

A number of emails are sent to the Client to inform him of the smooth running of the process.

6. Prices, Means of Payment and Payment Security

The prices of the paintings sold on the website are indicated in Euros, excluding delivery costs.

VAT, in France, does not apply to sales of the site according to article 293B of the General Tax Code.

Customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These rights and sums are not the responsibility of the Seller. They are the responsibility of the Customer and are their responsibility (declarations, customs fees, payment to the competent authorities, import VAT, etc.). The Seller invites the Customer to obtain information from the competent authorities.

The Seller reserves the right to modify its prices at any time, without notice.

Telecommunications and telecom operator costs relating to access to the website are the responsibility of the Customer.

The payment methods used on the website are as follows:

• Paypal (by paypal account or by credit card if you do not have a Paypal account)

In any case, your banking information is never communicated to the Seller.

7. Deliveries

The tables are delivered to the delivery address indicated by the Customer after payment of the entire order.

The order is usually shipped within 15 working days. The delivery time depends on the buyer’s country and the carrier used.

The risks of loss, damage or theft, etc … are transferred to the Customer when the latter takes physical possession of the painting upon delivery.

In the event of damage, it is the Customer’s responsibility to make specific reservations with the carrier and to send the Seller, by email or post, all documents, information and photos concerning the delivery and this at most late within 48 hours. In all cases, inform the Seller by telephone as soon as possible.

8. Intellectual property

Physically, the table will be the property of the Customer upon receipt of delivery by the carrier. However, the Seller retains the intellectual property of the work. Any total or partial reproduction, by any means whatsoever of the work purchased by the Customer, is strictly prohibited.

This concerns the original work but also the limited and numbered series editions.

In addition, all information, photos of tables, documents, texts, videos, etc. on the website are the exclusive property of the Seller and their reproduction or use is strictly prohibited.

9. Right of withdrawal

In accordance with the Consumer Code concerning products sold at a distance, the Customer has a period of fourteen clear days to exercise his right of withdrawal without having to justify reasons, nor to pay penalties, with the exception of the costs of return.

This 14-day period begins the day after the day of physical possession of the product by the Customer or any person designated by the latter.

To exercise this right, the Customer must notify the Seller of his decision to withdraw by informing him by post or email (see Article 1) and by returning the form below correctly filled in.

The Customer must return the painting with its certificate of authenticity within 14 days, in its original packaging or similar to protect the work as much as possible during transport.

The Seller will reimburse the Customer within 14 days of receipt of the painting and after verification of its good condition. The return costs remain the responsibility of the Customer.
Any restorations to restore the work will be deducted from the price to be reimbursed. If these are not possible, the work will not be reimbursed to the Client.

10. Complaints & Disputes

Only the General Conditions of Sale in French are used as contractual reference between the Seller and the Customer. All the articles and clauses appearing in the CGV, as well as all the operations referring to them are subject to French law.

Any dispute or complaint should be sent to our customer service using the “Contact Me” form on the website or by post to the address in Article 1.

Any return must be the subject of a prior written agreement from the seller.

In the event of disputes or complaints, the 2 parties undertake to seek an amicable solution. Otherwise, they will be subject to the exclusive jurisdiction of the courts of Paris (France).
